Employer's Refusal or Failure to Pay Wages
In Arizona, employees are entitled to be paid non-discretionary wages or other compensation promised by the employer and earned by the employee though work or labor. What this means is that an employer cannot promise certain wages or compensation to the employee, and then, after the employee performs his or her job, retroactively decide not to pay the employee the promised compensation. If an employer does so, the employee may be entitled to as award of triple the amount of wages due to them as a penalty to the employer. In this way, Arizona law protects against failures and refusals by employers to to pay compensation that the employee has earned and which are due to him/her.
Wages are not limited to just an employee's salary or hourly rate, but may include compensation in other forms, such as commissions, earned and accrued paid time-off, and promised non-discretionary bonuses and fringe benefits.
Federal laws, such as the Fair Labor Standards Act, address OVERTIME and MINIMUM WAGE violations. Arizona law also protects against MINIMUM WAGE violations.
