Family and Medical Leave Act ("FMLA)
The FMLA is a federal law which applies to employers with 50 or more employees. It entitles an eligible employee to unpaid leave for the following:
Birth or care of newborn
Placement of child for adoption/foster care
Serious health condition of employee or immediate family member
Military (active duty or care for injured service member)
To be eligible, you must have been employed with your employer for 12 months and worked at least 1,250 hours in prior 12 months. The purpose of the FMLA is to protect an employee’s job while on unpaid leave. An eligible employee is entitled to use FMLA leave and then return to work in the same (or equivalent) position and with the same benefits. An employer cannot retaliate against an employee for using FMLA leave (or interfere with the employee's ability to use FMLA leave.
