Employers cannot discriminate against employees on the basis of certain protected classifications or retaliate against employees that engage in certain protected activity.
Protected classes include:
Age (over 40)
Race/Color
National Origin
Genetic Information
Protected activity may include:
Reporting or opposing discrimination
Reporting or opposing illegal conduct
Participating in an investigation concerning protected conduct (ex. being a witness in an EEOC investigation or, in some cases, an internal investigation)
Reporting or opposing conduct based upon a reasonable belief the law in being violated
Engaging in conduct protected under the Arizona Employment Protection Act (e.g. worker compensation, jury duty, voting rights)
Requesting or using Paid Sick Time
Requesting or using medical leave (under the FMLA or ADA)
Requesting an accommodation for a medical condition or disability (flexible hours, remote work, unpaid leave)
Requesting a religious accommodation
Filing a Charge of Discrimination with the Equal Employment Commission or participating in an investigation of the same
